All our news sources have been overflowing with the details of eBay being made to pay £31 million damages to LVMH in the French courts so there is little point in reporting further on that in these pages. We have though, during June, reported on smaller cases where individual traders have been jailed for selling counterfeit and stolen goods via eBay.


eBay has long had the chance to clean up its act and, however much they protest, they have done very little to sort out these problems. Why? Because on every transaction they are making a profit!


The FT.com reported that yesterday on Ebay in the US there were more than 2,500 supposedly genuine Louis Vuitton handbags available whilst eBay in France listed only 80. Not much sign there of getting tough! Instead their spokesperson has just been whingeing on about brand owners' rights to protect their property and how it has ‘empowered’ so many thousands of sellers.


Well, I’m sorry eBay but I don’t agree. If I set up shop in my local high street and offered people the chance to display anything they wanted to sell in my window, I would have to take some responsibility as to the provenance of those goods and, if some of those people were selling their goods on a regular basis as part of a business, I would want a receipt from them for any money I hand over so my books balance.


Books have to balance and paperwok has to be correct because, as a shop owner, I am liable to pay tax, national insurance and business rates, an area much overlooked by many part-time eBayers.


This on-line auction house is creating an anarchic marketplace where anyone can sell anything, whether it has been physically stolen or it is just the brand owners' right to make a profit that has been stolen and where genuine retailers have to compete with the thousands of people eBay are empowering to work in the black market - selling from their spare bedroom and conveniently forgetting the overheads they should be paying.


At last eBay is being hit where it hurts by the brand owners. Hopefully more will be enouraged to take action. Maybe it’s also time to tip off the Revenue that there may be rich pickings here!
