Ebay sued by L’Oreal

Cosmetics maker L'Oreal began legal proceedings in the High Court today against online auction site eBay over the sale of fake fragrances and cosmetic products. The Paris based brand has also brought similar proceedings in for other other European countries as it attempts to stop sales of fake versions of its products.

L'Oreal alleges that the online auction site does not do enough to combat the sale of counterfeits.

Ebay's argument is that it only provides a trading platform for consumers to buy and sell products and that it is L'Oreal's responsibility to protect its trademark.

Henry Carr QC, representing L'Oreal, explained that the brand owner objects to counterfeits of its products, parallel imports, unboxed cosmetics and testers being sold and that eBay's methods of preventing their sale was "ineffective".

This latest case follows similar actions last year taken against ebay by the Louis Vuitton and Christian Dior goods brands owner LVMH.

The case is being contested by eBay.
