eBay guilty of selling counterfeit goods
eBay has been convicted of selling counterfeit goods on its French website.
Yesterday (June 4th), a court in France found the online auction site directly responsible for a woman who sold fake copies of two Hermes bags as well as one genuine bag.
The site and the seller have been jointly fined 20,000 euros, which will be made payable to Hermes.
In addition, the court ordered eBay to post the ruling on the homepage of its French site for three months.
The ruling said: "By selling Hermes bags and branded accessories on the eBay.fr site, and by failing to act within their powers to prevent reprehensible use of the site," the user and eBay "committed acts of counterfeiting and imitation of French brand names...to the detriment of Hermes international," the AFP reported.
According to auctionbytes.com, eBay accepted the court's decision but in a statement released in response to the ruling it asserted that there are better ways to fight the problem of counterfeit goods.
"We remain convinced that lawsuits against marketplaces are not the solution. Success in fighting counterfeits will be achieved only through the joint efforts, trust and cooperation of all the relevant stakeholders. Currently eBay works successfully with more than 18,000 rights owners around the globe to counter fraud and counterfeit."
